POLICY STATEMENT It is the policy of ϲʹ, so far as is reasonably practicable, but in accordance with the relevant legislation, statutory requirements and good practice, to ensure the health and safety of Staff, Students and Visitors of the University. INTRODUCTION In addition to those general duties in law, the University and its constituent Colleges and Professional Services have a specific obligations under the Misuse of Drugs Act, Management of Health and Safety at Work Regulations and the Provision and Use of Work Equipment Regulations, amongst others, to ensure that employees and others are not put at risk by work activities. Definitions: For the purposes of this Policy Standard and associated Information Sheet, Alcohol and Substance Misuse is defined as: The taking of alcohol, prescribed or controlled drugs or a substance, either intermittently or continuously, which interferes with an individuals health, work capabilities or conduct, or which adversely affects the work performance and/or safety of themselves and/or others BACKGROUND & GENERAL INFORMATION It is recognised that alcohol and substance misuse is often an illness and staff should, wherever possible, be assured that their desire to resolve dependency will be supported. However, it is also recognised that behaviour under the influence of alcohol or substance misuse can acutely impact upon the health and safety of that person and others, and is often unacceptable. Alcohol and Substance misuse can have a number of adverse impacts on the workplace. These include impacts on: Safety; an unsafe work environment with increased risks and accidents. Workplace relationships; the ill-effects of alcohol and substance misuse can impact on behaviour and relationships, e.g. an individual affected by alcohol may act unprofessionally and place unacceptable stress and pressure on others. Students: It is noted that this Policy does not apply directly to students. Support for any Student alcohol or substance concern can be obtained through Student Services. Issues with regards to Student Discipline or poor behaviour would be dealt with under the General Regulations, Student Discipline and/or Halls Disciplinary systems. THE UNIVERSITY The University is committed to providing a safe and healthy working environment and it recognises that such an environment can be put at risk by those who misuse alcohol or substances to such an extent that it could affect their own safety, health, performance, conduct and relationships at work and put at risk the safety of others. The consumption of alcohol whilst at work or prior to coming into work, should never be the norm. There will be occasions where Staff will have an option of consuming alcohol at work-related social occasions and where this occurs the member of staff would not normally return to work. Consumption of alcohol or being under the influence of alcohol whilst undertaking safety critical work, or other identified activities, as defined by the relevant College or Professional Service, is not permitted. Similarly, being under the adverse influence of substances whilst undertaking safety critical or other stated activity is not acceptable behaviour. Where a member of staff works in a safety critical role or where there is strong suspicion that a persons behaviour is putting others at risk, the University reserves the right to request that member of staff participate in Alcohol or Substance Testing. If a member of staff commits a clear breach of this Policy then action may be taken under the Universitys Disciplinary Procedures, as appropriate. Where an Agency Worker, Contractor, Visiting Academic, Intern or Work Placement is suspected of being under the influence of alcohol or substances whilst in a safety critical role, or their behaviour puts others at risk, the University reserves the right to exclude them immediately. If a member of staff acknowledges they might have an issue with alcohol or substances, the University will, where possible, provide support and encourage the staff member to seek specialist advice and treatment. COLLEGES AND Professional Services Deans of College and Directors of Professional Services are required to: Where a clear risk is identified, undertake an assessment to classify roles and activities which are deemed safety-critical and advise staff of these. Examples of such may include: Driving a vehicle Undertaking work with hazardous chemicals Clinical and biological work Work in a laboratory Use of equipment, electrical systems, lasers, radiation materials Heavy lifting and operating machinery Leading or participating in fieldwork Work offshore The above examples are non-exhaustive. Further guidance may be found in the associated Information Sheet: Safety Critical Roles, Alcohol Misuse. If managers are unsure whether roles are safety critical they should seek advice from the central Health and Safety staff. Support and signposting staff who may have alcohol or substance misuse problem to Human Resources. Advise colleagues to inform University Security of any person suspected or found in possession of, producing or attempting to produce, or supplying or attempting to supply illegal substances on its premises. University Security will then notify and liaise with the Police. In conjunction with Human Resources, put in place disciplinary measures, as appropriate, where alcohol or substance consumption or misuse could put themselves, a colleague, students or others at risk. In relation to hosting Work Placements, Interns, Agency Staff and Visiting Academics, apply the same principles as for members of Staff and, where appropriate, suspend the activity. Advise all Contractors and Visiting Academics and others who undertake work at the College/Professional Service, that substance misuse and the consumption of alcohol prior to or whilst at work is not acceptable. RESPONSIBILITIES OF STAFF AND OTHERS Each member of staff and others as listed by this Policy, has a responsibility to: Not consume or be under the influence of alcohol or substances during working hours, including when on-call. Notify their Line Manager immediately if using prescription or over-the-counter medication which indicates it could impair their fitness to work if and when driving for work, operating machinery or undertaking another safety-critical role. Seek help and if appropriate discuss any problems with their Line Manager, if they suspect or know they have an alcohol or substance related problem. Report any safety concern arising from a colleagues suspected alcohol or substance related problem or behaviour to their Line Manager or senior College or Professional Service manager. Be free from possession of any illegal substances on University premises or whilst performing work activity away from the University. Participate in Alcohol or Substance testing. 8. NON-COMPLIANCE Failing to comply with the Universitys Alcohol and Substance Misuse Policy Standard could lead to disciplinary action. Where Contractors, Visiting Academics, Agency Workers, Interns and Placements fail to comply they may be prohibited from working at the University. 9. Equality assurance It is recognised that there may be a requirement to treat Persons with an alcohol of substance dependency differently in order to safeguard them from potential harm whilst at the University and to safeguards others who may be impacted by their behaviour. REVIEW AND AUDIT PROCEDURES Colleges/Professional Services must periodically review their own procedures to ensure the requirements of this Policy Standard are implemented, suitable and effective. In addition, the Universitys Health and Safety Committee may from time to time review the effectiveness of the Universitys systems for alcohol and substance misuse. End.
